Wait isn't it like this...If you are under 13 years old, you CANNOT create a board but you CAN join a board UNLESS there is a COPPA?

The law applies whether or not you have COPPA enabled so they shouldn't register either way.
The law says no site may gather/receive information from minors under the age of 13 without parental permission (explicit authorization).

Exactly.
And come 2.0 COPPA will be mandatory on all boards (I think the ability to activate/de-activate will subsequently be removed?).
