If anyone's interested, the smiley that the Phrank one was based off of can be found here and is ok to use.
You'd have to ask Rory and Raven if you could use the one here, as they both worked on it.

 Basically ash to put this whole situation in a nutshell. I'd like to get it out there, your blowing this out of porportion, and your straining your ownself over it. If the IF staff has a problem, they will surely come to you and warn you about it, so there just wont be any instant removal or banning or shut down. If it was custom, then yes get permission, most likely you can create your own at smileygenerator. Your just confusing your own self over this whole smiley deal. Just find some and download a package. LOL
