Cracking boards is a violation of the TOS, spamming in an abusive form is a violation of the TOS, doing anything to purposely harm a board or it's reputation (such as taking over a board and linking to a rival to have them shut down) is a violation of the TOS. So yes what they do is illegal as far as the Terms of Service is concerned and I believe cracking is illegal in most countries though I'm not sure. I think Seth or Phrank may have a better idea of that sort of thing, they're smart. I'm not an admin so I honestly don't know how they are dealt with, perhaps DuffMan bans them from the server, perhaps he simply takes steps to ensure any board affected by them is secured or maybe they are just ignored since most people know they'll eventually go away out of boredom or rot in their cesspools. I'm not sure, I'm only a lackey.

You as a single fellow cannot use IP addresses to find name/address/telephone address. You can use the tracert xxx.xxx.xxx.xxx command to find where their ISP is linked, but that will be an approximate location. You still won't get access to their name, address, & telephone number, unless they do something terrible to your computer and you contact your ISP. Then, you sue them and take it to court.

Or maybe you could (if you can) track the 12-year-old down and talk to his\her parents. If you can't destroy them; the parents can.

We recently banned our first member. She ran off and started her own IF board, which was OK with me, maybe she'll stay away. To ban her, I made up a member group based on the "banned", but I went ahead and let view the board, thinking it was more cruel to dangle it in front of her out of reach. Unfortunately, I didn't realize "Update profile= No" meant that they could still update their signature. So she typed a nasty note in her sig with a link to "The Story of my Banning" (all the PMs that went back and forth over the stupid issue she decided to pit a fit about). So I reset the permissions. A couple of days ago, she rejoined under a new name (same IP) and within a couple of hours we had an incident on the board. So I have banned her IP. What I'm hearing from OcelotJay is that what she's doing is a violation of IF Terms of Service? Should I report this? Would they do something drastic like close down the other board? I'm not sure I want that, because then she'd have nothing to distract her from harassing us. |

well.... I'm not sure what I did different this time. But I thought you all deserved an update on the situation. I just recieved this email: Date: Tue, 15 Mar 2005 23:09:13 -0800 (PST) From: Send an Instant Message "Z******" <z*****@yahoo.com> Subject: why?why ban me? To: admin@****.com Dear adminteam, I can't even log on to your website. Your punishment is too harsh. Here is the wierd thing... I actually unblocked the IP along with the (*) wildcards cuz i didnt think they were working...and just kept his names blocked...i guess he got tired and just left. But he's only now complaining about not seeing the site. Not sure what happened. |

its sad yes, but the best way to do it would be to ban hotmail.com, yahoo.com, gmail.com, or any other free email account. They could email you and you Pre-Register them yourself ![]() If he cant view the board, i think its because hes banned, but then again, ive never been IP banned or name banned, only suspended by jermey

It would be a good idea to take action on the situation
He can be using a proxy IP.
There is a way that you can find out where they live. And then you just use the yellow or white pages to find out the rest |

Are you referring to my post just above? Yes, spamming a board in a harmful way is illegal as far as the TOS is concerned however I'd wait it out for now, how long has this been going on? I recommend giving it some time before thinking about taking action. Ignorant fools will go away in their own time for the most part, those who don't can be taken care of in some way. I'm not sure if her board would be closed down but I have heard of it being done so if it persists then send a report ticket (not a TOS violation report) and give as much evidence as possible and include her board. Which brings me to the next point, KEEP ALL EVIDENCE. Deleting spam seems like the best thing to do but I honestly say (with persistant spammers) move their topic to a trash or seperate forum, split their posts from topics and keep them in a hidden place. Mass spamming someone else's board is a violation of the TOS so if you can prove it's her (I'm guessing DuffMan will match IP's) then her board may be closed, or perhaps (if she is using severe abuse) she can be removed from the system. *shrugs* What I'm saying is not IF's opinion nor necessarily precise as I do not deal with such problems so all I can say (as a fellow board owner) keep the evidence and send a ticket for help.
In my honest opinion, if you're plan is to run a big board or a board you wish to grow that's the worst thing you can do. :/ How many people will go to a board, see how exellent it may be and then be happy to have to send an e-mail to register? I'm betting it would make most think twice unless you offered something they could deffinately not find anywhere else. For a small board though, it might not be so bad but no way could, say, the Skin Zone, or even here, have grown to the vast populace with ALL public e-mails being banned.
I'm unaware of any legal cases taking place but I'd bet if you even thought of taking someone to court over such a minor matter (and I speak of daily spammers, not people who can do actual harm to computers) you'd probably be laughed out of court. Unless it was your business that is, even then though....:/ In any case, Lisa, I'd recommend leaving it for now. Do what you must; ban, suspend, make her own group, whatever, but I wouldn't take action 1) without proof and 2) if this has only just begun. If you plan to run a popular and successful board, you'll need to learn to cope with such people but it is your right to have something done if they continue to return but, speaking as a board owner, give it quite some time. I had a spammer once, let him keep coming back for a month but in the end I won and he left.

Many thanks for your thoughtful response, OcelotJay. I have no doubt that it is the banned member, since her IP is static. I've banned the IP and hope she gets the idea and concentrates her efforts on more productive pursuits. My gut response is to wait as well. Hopefully she's neither energetic enough nor clever enough to realize switching ISPs will provide her renewed access to our board. I don't wish her ill, I just wish her gone. You're right in that we should expect this kind of BS. It's our first experience, though, and it's still shocking that some people can be so . . . out there. |

Never assume morons who won't leave you alone are part of these groups as it's likely they are not, most will make it clear that they are from the beginning anyway.
